Terms and Conditions

The following Terms and Conditions (“Terms”) apply to the provision of our online courses and other educational services (“Courses”) by us to you.
Please read them in combination with our Privacy Notice.
We, Formulator Hub Ltd (registered UK company 13121553 number), are trading as Formulator Hub. The company’s address is 2 Frederick Street, Kings Cross, London, United Kingdom, WC1X 0ND. Throughout these Terms, we will refer to ourselves interchangeably as “we”, “our”, or “us”. References to “you” or “your” apply to either of the following: Visitors to our websites formulatorhub.com and formulatorhub.study (“Website”), any app produced by us, or any other online point of access; Students of any of our courses; Paying customers.

1. Definitions

The following definitions and rules of interpretation apply to these Terms.

1.1 Definitions: "Confidential Information": Any confidential or proprietary information generated, created, or owned by us, however, recorded (including without limitation the courses, course materials, drawings, samples, client and supplier lists, plans, prototypes, models or methods, specifications, know-hows, commercial and financial data, and any information or analysis derived from this Confidential Information, the Intellectual Property Rights) which we directly or indirectly identify as such, either orally or in writing, or is clearly confidential from the circumstances and nature of the disclosure.
1.2 "Courses": the online education services delivered by us, including the course materials supplied by us to you  
1.3 "Course Materials", "downloads", "lessons", "modules", and "coursework": the written and recorded media provided supplied online to you to accompany the courses. 1.4 "Enrol", "Enrolment", "Enrolling": enrolment onto one of our courses, requiring payment per Clause 3, or a grant of access to our courses by some other means at our sole discretion.
1.5 "Intellectual Property Rights": patents, rights to inventions, copyright and neighbouring and related rights, moral rights, trademarks, business names and domain names, goodwill and the right to sue for passing off or unfair competition, rights in designs, rights in software, rights to use, and protect the confidentiality of, confidential information (including know-how and trade secrets), and all other intellectual property rights in the future in any part of the world.

2. General 

2.1 By using this website, registering an account with us, or enrolling on or using our courses, you agree that you have read, understood, and agree to be bound by these terms.
2.2 Additional terms and conditions for specific courses may also apply to those courses. We will inform you of these terms and conditions when enrolling on these courses.
2.3 We reserve the right to amend these terms from time to time. We shall notify you of any changes made.  

3. Enrolments, Course Payments & Cancellations

3.1 To access our courses via the website, you will need to enrol by signing up for an account and paying the relevant fee for access to the course. We reserve the right to grant or deny course access at our sole discretion.
3.2 Enrolment is only considered complete once payment has been made (either deposit for instalments or full payment) and has cleared. Alternatively, access has been granted in writing by us to you at our discretion.
3.3 Payment plan is not currently available.
3.4 Formulator Hub may offer a Payment per Module option in place of payment plans. This means that specific courses may be available for purchase per Module. One payment will unlock one Module. You can only purchase the complete program using this method; you cannot purchase random Modules of your choice. This payment option is available at our discretion and is not guaranteed. Please contact us for further information.
3.5 Payment per Module will incur a surcharge to cover the administrative costs. The current surcharge is displayed within the course section.
3.6 Payments are only accepted by credit or debit card. We do not accept payments by cash, cheque, or bank transfer.
3.7. Formulator Hub operates in the UK; therefore, all transactions are in GBP. Depending on your location, you may incur digital tax charges. Any charges by your bank, card handler or payment provider will be your responsibility.
3.8 Cancellation and refund policy: Your statutory right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 in the UK means that you waive your cancellation right once you have accessed any of the digital course materials.
3.9 You may request a refund within 14 days of purchase if you have yet to access our course materials. To request a refund, please send us an email at [email protected]. We will verify your account and confirm the issue of a refund (if approved) within five working days.

4.  Our services

4.1 We guarantee that our courses will be delivered to you using reasonable care and skill.
4.2 We shall supply our courses to you following the relevant course description.
4.3 We shall use all reasonable endeavours to meet any performance dates specified in the relevant course description, but any dates shall be estimates only and time shall not be of the essence for our performance in delivering our courses.
4.4 We reserve the right to amend the website and course descriptions to comply with any applicable law or regulatory requirement or if the amendment will not materially affect the nature or quality of the courses. We will notify you of these amendments.
4.5  Every effort has been made to accurately represent achievements resulting from completing our courses. The level of success in attaining any results claimed in the course or marketing materials depends on various factors such as time invested, implementation of acquired knowledge, ongoing practice and learning, and other skills. These factors differ according to individuals; therefore, we cannot guarantee the student's success.
4.6 We have taken all reasonable care in sourcing and presenting accurate information during the course. We do not warrant that any content created by us, any third-party suppliers of goods or services, or any content provided in the course materials or our courses will be error-free. No responsibility is accepted for any inaccuracies, mistakes in the information, or any loss or damage resulting from its use.
4.7 A course may have an end date or limited timeframe in which you have access. Where this applies, we will inform you of it in the course description, and you acknowledge that it is your responsibility to complete your course within this time.
4.8 A course may have a deadline for submitting coursework, assignments, tests and quizzes. Where this applies, we will inform you of it in the course description, and you acknowledge that it is your responsibility to submit your coursework, assignments, tests and quizzes before the deadline. If you submit your coursework, assignments, tests or quizzes after the deadline we have the sole discretion to refuse to accept your submission, and if we do accept your submission, an administration fee will apply. 4.9 We aim to provide uninterrupted access to the course and its related course materials for the duration of the course. You acknowledge that occasionally technical difficulties may interrupt services. We will use our best endeavours to resolve any technical difficulties and to resume standard service as soon as is reasonably practical.

5. Your obligations

5.1 You confirm that you are over the age of 18.
5.2 You agree to treat confidential information confidential.
5.6 You agree to use the website and courses in a way that does not infringe on third parties' rights (including the Intellectual Property Rights or confidential information of third parties).
5.7 Your work or content you submit it to us must not infringe any third-party Intellectual Property Rights.
5.8 You agree not to access or attempt to access any other account on the website or courses, impersonate anyone else, or otherwise misrepresent your personal information or identity.
5.9 You agree that all communications made through the website or on courses constitute a public discussion.
5.10 You agree not to knowingly transmit any data that contains any harmful software programs or code to us, the website, or any other users of the website or courses. 5.11 You agree that you are solely responsible for (and that we have no responsibility to you or any third party for) any breach of your obligations under these terms and for the consequences of that breach.

6. Limitation of liability

 6.1 The website, course materials and courses are provided to you "as is", we make no representation of their accuracy, completeness, or whether or not they are up-to-date or that they will meet your requirements.
6.2 Any formulas provided to you were designed by a qualified cosmetic chemist and are for demonstration/ education purposes only and cannot be sold or distributed.
6.3 All formulas were designed by a qualified and experienced Cosmetic Chemist and were stability tested. We cannot guarantee the success of these formulas if you alter any components. This is the nature of formulating cosmetics.
6.4  Any formulas provided to you may cause allergic reactions in some individuals, and we shall not be liable to you in those cases. Please conduct patch testing if in doubt before using/ trialling a formula.
6.5 We will take reasonable measures to ensure your security while using the website and the courses. However, we accept no responsibility or liability for using them, which is entirely at your own risk.
6.6 We make no representation or warranty that the operation of the website or the courses will be timely, secure, uninterrupted or error-free and disclaim all liability to the greatest extent permitted by law.
6.7  Subject to clause 9.6, the entire liability of the company to you in respect of any claim or our breach of this Agreement, whether or not arising out of negligence, shall be limited to the fees paid by you for the course to which the claim relates.
6.8 Subject to clause 6.9, we shall not be liable to you for any loss of business; any loss of opportunity; loss of profit, any indirect or consequential loss, any allergic reaction or harm caused to you by not following our advice (6.4)
6.9  Nothing in these Terms and Conditions shall exclude or limit the company's liability for death or personal injury caused by negligence.

7. Intellectual Property

7.1 We own the Intellectual Property Rights in connection with our websites and our courses.
7.2 Subject to your compliance with these terms, we grant you a revocable, worldwide, non-exclusive, non-assignable, non-sub-licensable limited licence to access the website. We also give you access to the courses (at our discretion and usually subject to the creation of an account and enrolment without cancellation) as an individual for private individual study and to download content for the same purpose.
7.3 Upon enrolment, you understand that you are prohibited from copying, sharing, selling or otherwise distributing our course materials to third parties. You cannot digitally alter any of our course materials. Breaking this clause will result in the immediate termination of your access and can result in legal action against you.
7.4  We do not own any content uploaded to our website or submitted by you. You retain all your ownership rights in your content, but you grant us and other users of the website and courses a limited licence to use that content in any way we choose and to make it available to third parties. Any content created by you that you submit to us or upload to our website will be treated as confidential unless we obtain your permission to publish. You expressly consent to us using any positive feedback given to us by you to promote our services.

8. Code of Conduct 

8.1 You promise to conduct yourself professionally, respectfully, and responsibly when using the student forum on any social media associated with us.
8.2 You agree to behave professionally, respectfully, and responsibly during the course. We reserve the right to cancel your enrolment and withdraw you from the course without a refund if you break this code of conduct.  

9. Site Terms of Use Modifications

Company may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

10. Governing Law

These Terms are governed by the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction over any dispute arising from, or in connection with, them.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Formulator Hub at any time without a refund. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any copied/downloaded materials in your possession whether in electronic or printed format.
